Wrongful Death

The death of a loved one is devastating. When that death was caused by the actions of another it can be difficult to deal with. The law calls these situations wrongful death. While we at G. Eric Nielson & Associates cannot ease the pain of dealing with your loss, we can minimize the financial burden your loss may have caused.

Wrongful death can arise under a number of circumstances. Automobile accidents and other acts of another’s negligence or recklessness can result in the untimely death of a loved one. Product liability cases involving defective products or drugs may also give rise to a wrongful death claim.

We also see many wrongful death cases in medical malpractice situations. A missed or delayed diagnosis of cancer, heart disease, or the onset of a heart attack can be deadly. And patients in a hospital who develop sepsis can die without early diagnosis and treatment.

Wrongful death claims allow the surviving family of the deceased to recover certain expenses from the liable party. Examples of such expenses include funeral costs, loss of earnings or inheritance, and pain and suffering.

These claims should be discussed with a lawyer experienced in recognizing and dealing with wrongful death claims. There may be limitations on how long one may have to bring the claim, and on who may be eligible to bring it.

Where a wrongful death claim involves a particularly complicated part of the law, such as medical malpractice or product liability, it is important to have a skilled attorney. At G. Eric Nielson & Associates our only focus is medical malpractice. If you have any questions, contact an attorney skilled in wrongful death medical malpractice.
